The design of managed access highways, located within the limits of cities and towns, has been a contentious issue between cities and WSDOT - sparking debates over who has responsibility for the design of roadside elements.  The debate has been prompted primarily due to the uncertainty over who is ultimately responsible for the design of elements outside of the curb.  As a result of this uncertainty, a task group was formed to clarify the design responsibilities between cities/towns and WSDOT, with regards to roadside treatments.

The task team began their clarification effort by developing a summary of applicable WACs, related to urban roadway design, and presented this information to the Safety and Aesthetics Interdisciplinary Group, at their November 26, 2001 meeting.  From the summary of applicable WACs, the team then developed recommendations to clarify jurisdictional roles.  Those recommendations were then presented to the WSDOT Executives team.  The Executives agreed with the recommendations and a draft Instructional Letter (IL) was prepared.  The IL outlines the jurisdictional roles and defines the necessary clarification revisions to the WSDOT Design Manual and the Local Agency Guidelines (LAG) manual.  The IL was widely distributed for review and comments during the fall of 2002.  The IL was revised to reflect the comments received and was  recently signed into effect by Don Nelson (Director of Environmental and Engineering Programs), with an effective date of January 22, 2003
