Project Legal Requirements
Overview
Delivery of a highway project in Washington State is a complex process and is dependent upon numerous entities for review, approval, cooperation, and coordination. A myriad of Federal, state, and local laws and regulations govern all aspects of project delivery - the planning process, environmental review, design, utility relocation, right-of-way acquisition, contracting, construction, maintenance, and operations. The complexity of these various regulations, and the uncertainty surrounding actual legal requirements are frequently cited as causes for delays in project delivery.
The Office of Innovative Project Delivery has developed a series of flowcharts that outline the Federal and state requirements in the project delivery process and provide references to the relevant legislation and regulations. Please note that these flowcharts contain only Federal and state requirements; WSDOT policies and procedures will still apply.
